<p>First impressions of a home go a long way to determining how quickly it will sell. Here are a few suggestions that will make your home show well.</p>

<li><strong>Be sure the approach to your home is clean, tidy and well groomed</strong>. Any brass should be polished, paint on the door should be in good condition and the door should be washed clean of fingerprints and paw marks.</li>
<li><strong>If your home is a single family house</strong>, be sure the grass is cut, leaves raked, plant beds mulched and weeded, etc.</li>
<li><strong>If your home is in a multi-family building</strong>, be sure the approach and hall to your home is clean even if it is not your job!</li>
<li><strong>Be sure your home is tidy and uncluttered</strong>. This includes closets, cabinets, garages, and other storage areas. When &#8220;stuffed,&#8221; no amount of storage &#8220;shows&#8221; as adequate. When really messy, no room looks charming.</li>

<li><strong>If your carpet is in poor condition</strong>, but you cannot afford to replace it, get several neutral samples in a mid-price range from a local carpet store, spread them on the floor, and add a note stating that you will be glad to provide a carpet allowance from the proceeds of settlement.</li>
<li><strong>Dark homes show badly</strong>. Make sure lamps are on and lampshades are straight with the seams toward a wall. Make sure there is as much natural light as possible; have curtains, shades and blinds open.  Buyers are looking for a home they can see themselves living in. <p>Sometimes in life we may face situations where it is best to cut your losses and  run. If the loss is your home, it is likely that the decision to do this is understandably made almost too late. If you are in the unenviable position of having to sell up and downsize because of escalating costs, an efficient real estate agent can be your best friend.</p>
<p>If your home is now worth less than you owe on it, he/she will be familiar with procedures and will be able to guide you through the differing aspects of negotiating a short sale. The term &#8217;short sale&#8217; simply refers to the fact that the current market value of your property is short of the actual figure that you owe on it.</p>
<p>Unfortunately, because of past financial practices that have largely been rectified by now, many thousands of home owners find themselves in this untenable situation. Three quarters of known housing markets in USA have suffered continuing price decreases. These figures are released by Global Insight, who quote that single family house prices have dropped for the third consecutive period in 262 out of 330 markets.</p>
<p>When mortgage rates increase in the same time frame that housing values decrease and world food and gas prices increase, it makes it impossible to live on the originally planned budget. If the only answer is to sell your home, you should be aware that a short sale is different to selling your home under normal conditions.</p>
<p>Usually, the lender may not even know that your home is on the market until your lawyer pays off the mortgage. However, with a short sale, the lender must be in on it from the beginning. There is also more paperwork for you to take care of with a short sale.</p>
<p>For instance, you must give permission, in writing, for the lender/bank to communicate with your real estate agent. An even more complex task is to document all the reasons why you cannot pay the amount that you owe. This is called &#8216;proving hardship&#8217; and attached to your letter of explanation will be bank statements, credit card bills, W-2s and any other proofs of inability to pay.</p>
<p>This hardship statement does not absolve a home owner from responsibility for the debt owing &#8211; but it may. The attorney or title company that will be handling the paperwork for you can make the approach to your lender for &#8216;forgiveness&#8217;. Lenders do not wish to accumulate a mass of homes; they are in the money business. If the short sale route is accepted by your lender, it will save him time and money over the other alternative he has: a foreclosure on the loan.</p>
<p>Foreclosures are very expensive and time consuming for the lender; too many foreclosures on the books can also jeopardize the lender&#8217;s future loans from being insured. In short: a lender will prefer a short sale and if you are co-operating by offering one &#8211; what&#8217;s in it for you?</p>
<p>A short sale may still affect your credit rating, but if you could come out of it with the debt cleared (or &#8216;forgiven&#8217;), you could have a fresh start. If your lender &#8216;forgives&#8217; you then a 1099 must be issued so that the amount of the excused debt is documented for you, the seller, to declare to the IRS at tax time.</p>
<p>All liens on the home will have to be released before it can be sold; this includes the lender&#8217;s lien. If you can work to keep your lender&#8217;s good will, or at least co-operation, a transaction may run more smoothly.</p>
<p>As in most walks of life, compromise and patience are also invaluable commodities in short sales.</p>

<p>The home selling and buying process can be confusing, particularly when it  comes to figuring out what items stay with the home. This is especially true when it is a FSBO (for sale by owner) operation. It&#8217;s even tougher when neither the seller nor the buyer is in the real estate business. This article sorts out what personal property stays with the home when it is sold.</p>

<p>Although every state has slightly different rules, there are general guidelines to what goes and stays when a house is sold. Typically, any items attached to the home stay with it while non-attached items are considered personal property and go with the seller. For instance, the seller typically takes personal property such as tools and potted plants.</p>
<p>Certain personal property items, however, don&#8217;t always go with the seller. In Virginia, items such as stoves, washers and dryers, refrigerators and built-in microwaves usually stay with the home when the buyer moves in.</p>
<p>If you&#8217;re a seller and you don&#8217;t offer the items generally expected to convey, you make your property less attractive than the competition. With the red-hot real estate market, it may not matter. You may still sell your property quickly and easily.</p>
<p>Conversely, if you&#8217;re a buyer, you can gain an edge with a seller who wants to keep an item of personal property. Allowing them to haul off a particular item is a good way of building good will. When deciding how you want to approach your options here, consider how competitive the situation is and the monetary value of the item. You always want to keep the big picture in mind.</p>
<p>As with most things related to the real estate buying and selling process, keep in mind the relationship between the parties. The buyer and seller are not enemies and all items on the table don&#8217;t carry equal importance for both parties. If you are willing to be reasonable, there is almost always a win-win solution.</p>

And, for the brave and hopefully, very experienced, there are on-line, fill in the blank, sales contracts.</p>
<h3>Why use a broker?</h3>
<p>Does the above discussion leave you feeling insecure instead of alert, thoughtful, and excited? If so, you probably want a real estate broker to sell your home for you.</p>

If you try, use the tips here to do it right, and to avoid common mistakes.</p>
<p>1. Understand house values. It&#8217;s not what you think your house is worth, and it doesn&#8217;t matter how much you put into it. The value is only what it&#8217;s worth to potential buyers. See what they&#8217;ve paid for similar homes before you decide on a price.</p>
<p>2. Try to be objective. Get your most honest and open friend to walk through the house with you. He or she will see problems you didn&#8217;t even know were problems.</p>
<p>3. Make a plan. What will your kids say to those who call? Where will you close? Will your documents be prepared by an attorney? Plan well, and it will all go smoother.</p>
<p>4. Start a list. What needs to be repaired, cleaned, changed, or removed? Always do the most obvious things first.</p>
<p>5. Prepare to sell. List questions a buyer might have, and be ready with answers. Prepare comparison sheets showing other home sales, so buyers can see the value. Make a map showing nearby stores and libraries, etc.</p>
<p>6. Sell the benefits, not the features. Never say &#8220;near stores.&#8221; Instead, say &#8220;You can walk to the store in five minutes.&#8221; Don&#8217;t just say &#8220;garage.&#8221; Try &#8220;No chipping ice off the windshield in the morning.&#8221;</p>
<p>7. Put all important information in ads. Include the square feet, number of bedrooms and bathrooms, address, telephone number, and price. Leave out the price and some buyers just won&#8217;t call, plus you&#8217;ll waste time with others who shouldn&#8217;t be calling.</p>
<p>8. Listen to buyers. One mistake sellers make talking to buyers is to get defensive about their home. Listen to the criticisms, and resolve them or ask how important the issue is to the buyer. In other words, try to learn a little about selling.</p>
<p>9. Have a clear sales agreement. Be sure it&#8217;s understood by both sides. What happens, and when? What if the buyer doesn&#8217;t get financing? What&#8217;s included with the sale? When will the buyer take possesion? Who pays the closing fee and the transfer tax?</p>
<p>10. Make closing easy. Have documents ready to sign. Prepare answers to likely questions. This may be the largest financial transaction in your buyer&#8217;s life, so make him comfortable.</p>
<p>There&#8217;s more than can be covered in ten tips, of course. Use these however, and you&#8217;ll be doing better than the average seller when you sell your own home.</p>

By completing an exchange, the owner can dispose of their investment property, use all of the equity to acquire replacement investment property, defer the capital gain tax that would ordinarily be paid, and leverage all of their equity into the replacement property.</p>
<p>A Breach Of Contract occurs when a party is in violation of a direct obligation or failure to perform provisions in the contract agreement. In the world of real estate, a contract breach occurs most often in two ways 1 A failure to perform in the property listing agreement between the broker and the seller. 2 A violation of terms in the sales contract between the buyer and the seller.</p>
<p>Contingencies in real estate contracts are the specific clauses in the contract that must be fulfilled by both the buyer and the seller, or provide a way to void the contract. For example, a current home sales contingency is often used when a buyer is making an offer on a home before selling the existing home. The buyer may need to sell the present home before being qualify and afford the purchase. Therefore, the offer is contingent upon the sale of the existing home. Key standard contingencies include home inspections, financing, and appraisal.</p>
<p>The Alienation Clause Due on Sale Clause is the specific verbiage in a mortgage or deed which asserts the lenders option to force that the balance of the secured debt becomes immediately due and payable if the property is sold by the borrower, thus preventing the homeowner/borrower from assigning the debt without the lenders approval. Comes from the term alienate, which means to transfer or convey the title to a property from one party to another.</p>
<p>Exclusive Right to Sell is a common type of real estate listing agreement. A specific broker is given the exclusive right and authorization to market the sellers property. A key to this agreement is that if the property is sold while the listing is in effect, the seller must pay the broker a commission regardless of who sells the property. Therefore, this type of listing agreement offers the best opportunity for brokers to earn a commission. This is also known as an exclusive agency listing.</p>
